HARERA Initiates Penal Action Against Nitara Projects for Unregistered Sales in Gurugram

Gurugram, May 14, 2026: The Haryana Real Estate Regulatory Authority (HARERA), Gurugram, has initiated suo moto action against Nitara Projects Limited for allegedly developing and selling residential floors without mandatory registration. The Authority moved under Section 35 of the Real Estate (Regulation and Development) Act, 2016, after observing that the promoter was marketing and selling units without a RERA registration number, a DTCP license number, or the required disclosures on its promotional materials, HARERA said in a press release.
Despite a show-cause notice issued on April 16, 2026, the promoter failed to submit a reply or appear during a scheduled hearing on May 11. Consequently, HARERA has granted a final opportunity for the developer to explain why penal action should not be taken. The Authority warned that failure to appear or file a response by the next hearing date, June 8, 2026, will result in ex-parte proceedings and potentially stringent penalties.
The regulator noted a concerning trend where developers purchase plots in licensed colonies to construct and sell individual floors while circumventing oversight. HARERA reiterated that such practices are a clear violation of the Act. To protect consumer interests, the Authority issued an advisory urging homebuyers to verify project statuses on the official HARERA website, noting that “investment in unregistered projects is undertaken at the buyer’s own risk, cost, and consequences and may deprive you from the reliefs granted under the RERA Act.”
