SC decision brings relief to Civitech’s Sampriti buyers

With the Supreme Court recently quashing the Allahabad High Court order of May 6 last year impounding acquisition of 2,530 square metres of land for a group housing project in Noida’s Sector 77, homebuyers of Civitech’s Sampriti’s project have heaved a sigh of relief. The HC had also quashed the lease deed executed between the realtor and the Noida Authority on October 31, 2010.
The HC had quashed the acquisition of land at village Sarokha bearing Khasra Number 103/1M. The petition was filed by a farmer Devi Singh pertaining to quash the acquisition of one-fifth part of the said Khasra number. Singh had claimed that the said land is part of Civitech’s residential project Sampriti’ at Sector 77 Noida.
Talking to Realty & More, Subodh Goyal, CMD, Civitech Developers Pvt. Ltd., explained that the land was acquired by the Authority in 2005 and allotted to the developer on August 31, 2010. The construction of the Sampriti project, he said, started in 2011. Devi Singh filed a petition in the court in 2012 with a request that the approx 500-metre land, which is a part of the Civitech project, has not been acquired by the Authority. He urged the court to cancel the lease of this particular land piece / part but was unable to provide any proof to back his claim.
After the adverse verdict by the Allahabad High Court, Civitech along with the Noida Authority had appealed in the Supreme Court which recently quashed the HC decision.
