SC stops demolition of Noida towers, Supertech, buyers to maintain status quo
The Apex court on May 5 ordered status quo on an order to demolish Supertech’s two under-construction 40-storey towers in the real estate firm’s Emerald Court project.
A bench headed by Chief Justice RM Lodha issued notices on a batch of petitions by the builder, Noida Authority and the home buyers, and asked parties to maintain status quo in all respect.
The bench, while questioning the sanction plan by the authority to raise 40 floors on an area that initially had a sanction only for 9 floors, restrained Supertech from alienating any part of the buildings or creating any form of third party interests.
The court order came while hearing the builder’s plea for immediately staying the Allahabad High Cour order on demolition of towers Apex and Ceyane – be immediately stayed.
Real estate developer Supertech has also filed an appeal against the high court’s verdict. The two towers have 857 apartments in total. Of these, about 600 flats have already been sold.
In the petition, the firm has claimed that the two towers were being constructed as per “approved building plans” and “there is no violation”.
