UP RERA Grants Four-Month Extension to Real Estate Projects Amid West Asia Crisis

Lucknow, August 26, 2026: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has issued directions to extend the validity of registration and stipulated completion periods for eligible registered real estate projects in the state by four months. The decision follows an advisory issued by the Ministry of Housing and Urban Affairs, Government of India, on July 31, 2026, in response to the adverse impacts of the ongoing situation in West Asia on construction progress and real estate project supply chains, UP RERA said in a press release.
The central ministry’s office memorandum had advised real estate regulatory authorities across the country to consider issuing common orders to grant relief to projects impacted by force majeure conditions, avoiding the need for individual applications from developers. Exercising its powers under Section 37 of the Real Estate (Regulation and Development) Act, 2016, UP RERA ruled that registered real estate projects with completion dates falling between February 28, 2026, and October 31, 2026, will receive the four-month extension, effective from the last date of their existing registration validity. Projects that have already received a Completion Certificate or Occupancy Certificate are excluded from this relief.
The extension is subject to key regulatory compliances. To qualify, projects must have a valid sanctioned map, layout, or building plan as of February 28, 2026. Developers must also have filed all Quarterly Progress Reports (QPRs) due up to the last quarter of their registration validity and submitted their Annual Audit Report (REG-5) for the financial year 2024-25. Eligible projects meeting these criteria will see their registration extended automatically. Developers who have defaulted on any of these three conditions may apply for the extension after completing the pending requirements, subject to verification by the Technical Division of the authority.
UP RERA clarified that the extension applies exclusively to the validity of the project registration and completion timeline recorded with the regulator. The contractual rights and obligations between promoters and allottees under executed Agreements for Sale remain unchanged. The stipulated date of possession in existing agreements, as well as provisions regarding interest payable for delays or payment defaults by either party, will not be affected by the order.
The authority stated that the objective of the order is to provide targeted relief to eligible projects impacted by extraordinary external circumstances while safeguarding the contractual rights of homebuyers. The directions have come into force with immediate effect.
