RERA Gurugram Cautions Homebuyers to Purchase Properties Only Through Registered Real Estate AgentsGurugram, July 16, 2026: The Real Estate Regulatory Authority (RERA) of Gurugram has issued a strong public advisory cautioning homebuyers and encouraging them to purchase properties exclusively through RERA-registered real estate agents. The regulatory watchdogs emphasized that restricting transactions to registered intermediaries is vital to ensure all property deals remain genuine, transparent, and legally compliant, RERA Gurugram said in a press release.

According to the Authority, dealing only with RERA-registered agents helps homebuyers secure the structural protections and statutory remedies made available under the RERA Act in the event of any future transaction disputes. By seeking assistance through licensed professionals, buyers can utilize the formal regulatory framework to establish clear accountability and find legal redressal if grievances arise at a later stage.

Highlighting the legal requirements of the market, the regulatory body pointed to strict federal mandates governing property transactions. “The Real Estate (Regulation and Development) Act, 2016, mandates that no real estate agent shall facilitate the sale or purchase of any property in a real estate project without obtaining registration from the Regulatory Authority,” the advisory emphasized.Prospective buyers are being strongly advised to carefully review the detailed guidelines and instruction manuals concerning real estate agents before investing. This complete directory and information relating to active agents are available on the official RERA Gurugram website, allowing consumers to verify credentials prior to making any financial commitments.

Under the RERA Act, a real estate agent is broadly defined as any person who negotiates or acts on behalf of another party in transactions involving the sale or purchase of a plot, apartment, or building within a registered project. This definition also covers anyone who introduces prospective buyers and sellers for such transactions in exchange for commission, fees, or other monetary considerations. In practical terms, this legal classification encompasses all property dealers, brokers, consultants, and middlemen, regardless of their local designation.Consequently, any individual acting as a real estate agent without obtaining formal registration from RERA is legally prohibited from advertising, marketing, facilitating, or undertaking the sale and purchase of properties covered under the Act. Doing so without compliance constitutes a direct violation of regional real estate laws.

The regulator pointed out that Section 9 of the Real Estate (Regulation and Development) Act, 2016, makes it absolutely mandatory for every real estate agent to obtain active registration with their respective state authority before engaging in any transactions. This crucial provision was explicitly enacted by lawmakers to promote transparency, enforce accountability, and ensure consumer protection within India’s rapidly growing real estate sector.
