Allottee Gets Possession After 6 years, U.P. RERA ensures delayed interest
Due to the efforts of U.P. RERA– Conciliation Forum, an allottee of Ghaziabad-based ‘Bharat City 2’ project, Ajay Kohli, got possession of the unit and interest of delay period. The project is being developed by the promoter ‘M/s BCC Infrastructure Pvt. Ltd.’, says a press release issued by UP RERA.
As per the agreement between the parties, the allottee got the possession of the unit after 6 years and for interest of delayed period, the promoter agreed to adjust the amount in advance maintenance charges for one year and allowed the first transfer of the unit free of cost. The allottee also received the remaining amount of Rs 75 thousand.
As per the ‘Agreement for Sale’ the allottee had booked a unit in the project in April 2014. The allottee had paid about Rs. 26 lakh 14 thousand for the unit costing about Rs. 27 lakh 54 thousand. The possession was proposed in April 2017 but it did not happen as per the agreement. After delay in possession, the allottee filed a complaint in 2021 in U.P. RERA (NCR145/12/86927/2021) and asked to ensure possession and interest for the delayed period. The order passed in the hearing came in favour of the allottee, which was to be complied with by the promoter.
The allottee had registered a ‘request for execution of the order’ online on the portal to ensure the implementation of the passed order. While conducting an advance hearing in the matter, the Authority came to know that the promoter had offered the possession to the allottee but had not adjusted the charges for which the allottee had requested to calculate the charges and settle the matter through amicable settlement and thus the matter was transferred to the Conciliation Forum for mutual settlement.
