RERA Notice Against L&T Overturned by Allahabad High Court
Noida, October 8, 2024: The Allahabad High Court has struck down a notice issued by the Real Estate Regulatory Authority (RERA) against Larsen & Toubro (L&T), paving the way for the sale of flats in its Green Reserve project in Sector 128.
In a significant ruling on October 1, the court dismissed RERA’s claim that L&T’s sale of flats was illegal due to a lack of registration. The judges found that since RERA failed to respond to L&T’s registration application within the stipulated 30-day period, the project was automatically deemed registered under Section 5(2) of the RERA Act.
The court also rejected RERA’s insistence on including Jaypee Infratech Ltd (JIL) as a co-promoter in the project, upholding L&T’s argument that it had acquired the necessary rights to develop the project through an agreement with JIL.
As a result of the court’s decision, L&T is now free to proceed with the sale of flats in Green Reserve and can continue its advertising efforts. The court has ordered RERA to issue the necessary registration numbers and access credentials to L&T.
The case has significant implications for the real estate sector, as it clarifies the rights of developers and homebuyers in situations where RERA delays or fails to act on registration applications.
