UP-RERA Publishes Consolidated General Regulations Incorporating All Amendments

Lucknow/ Gautambuddh Nagar, August 19, 2026: The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has published the consolidated Uttar Pradesh Real Estate Regulatory Authority (General) Regulations, 2019, integrating all 12 amendments notified up to July 13, 2026. The consolidated framework brings together provisions aimed at increasing transparency, accountability, financial discipline, and homebuyer protection across the state’s real estate sector, UP-RERA said in a press release.

The consolidated regulations codify detailed norms across several key operational areas, including project bank account management, transfer charges, real estate agent compliance, Interest-Free Maintenance Security (IFMS) deposits, advertisement disclosures, and project transfer procedures.

Professional Reporting and Promoter Profiles

Under the updated framework, promoters must submit details of key professionals associated with a project—including the architect, engineer, and chartered accountant—alongside Customer Relationship Manager details and dedicated toll-free contact numbers. Quarterly Progress Reports (QPRs) must now be submitted through these named professionals with digitally signed certificates to enhance reporting accountability.

Additionally, promoters are required to establish and maintain active profiles on the UP-RERA web portal to access project registration dashboards. These profiles must be updated upon applying for new project registrations or whenever changes occur regarding directors, trustees, financial statements, or tax filings.

Compliance, Documentation, and Possession Norms

The regulations require promoters to submit a digital connectivity plan upon project registration and provide four dedicated email addresses covering registration, administrative matters, consumer complaints, and stakeholder communications. To prevent misrepresentation, project titles used in marketing must strictly align with the titles on approved sanction plans. Furthermore, offers of possession must follow a standardized format prescribed by UP-RERA to minimize financial and account discrepancies during property handovers.

Through provisions introduced in the 8th Amendment, allottees of unregistered projects are permitted to file complaints via the UP-RERA online portal in the same manner as allottees of registered projects, provided they supply necessary project and promoter details to facilitate adjudication.

Standardized Fees and Transfer Charges

UP-RERA has established fixed administrative charges and late fees for statutory delays. Promoters face a late fee of Rs 15,000 for each delayed QPR and Rs 25,000 for delayed annual audit filings. Real estate agents face a fee of Rs 10,000 for delayed quarterly transaction reports.

Transfer charges for property successions and assignments have also been capped. In cases of natural succession involving immediate family members, the transfer fee is fixed at Rs 1,000. For non-family assignees or successors, the fee is capped at Rs 25,000.

Three-Tier Bank Account System

To prevent the diversion of project funds, Regulation 53 enforces a three-tier banking structure within the project district, requiring promoters to operate separate Collection, Separate, and Transaction accounts. Under this mechanism, 70 percent of funds deposited into the Collection Account must be transferred daily to the Separate Account, while 30 percent is routed to the Transaction Account.

No liens are permitted on the Collection or Separate accounts. All project-related loans must be credited directly to the Separate Account, and cash receipts from buyers are strictly prohibited. Annual audit reports for these accounts must be uploaded to the UP-RERA portal, and Collection Account details must appear on all promotional materials and buyer documents.

Agent Certification and Maintenance Deposits

Real estate agents are now required to complete a mandatory short-duration training program to obtain or renew their registration. Agents must also maintain statutory registers and file quarterly transaction reports on the regulatory portal.

The regulations also establish guidelines for Interest-Free Maintenance Security (IFMS) deposits. Promoters must place IFMS collections into a dedicated scheduled bank account and transfer full operational control of the corpus to the Residents’ Welfare Association (RWA) upon handing over common areas. The funds are restricted to the maintenance, repair, and replacement of shared infrastructure and must undergo annual audits by a Chartered Accountant.

Marketing Rules and Project Status Adjustments

Promotional materials, brochures, and advertisements must prominently display the project registration number, UP-RERA portal link, project QR code, Collection Account details, launch date, and agent registration numbers.

The consolidated text also outlines standardized procedures for project registration extensions, project withdrawals where development has become unfeasible, and the transfer of majority promoter rights to third-party entities.
